What is Birth Injury?

The birth injury lawyers at our Pennsylvania firm understand that birth injuries present serious emotional, financial, and physical burdens to both parents and victims. Injury occurring just before, during, or immediately after the birth of a child is classified as a birth injury. Birth injury is often the result of pregnancy, labor or delivery problems. A common cause of birth injury is an interruption in the flow of oxygen to the brain, which can result in birth injuries such as brain damage and cerebral palsy. Erb's palsy - damage to the nerves that control the arm, can result from shoulder dystocia during the delivery. Other problems with pregnancy and the birth process can lead to injuries such as fetal distress, dysfunctional and or prolonged labor, seizures, and excessive bleeding. Our birth injury lawyers in Philadelphia, Pennsylvania can review your case and help you decide what steps to take if your child suffered injury at birth.

Birth Injury Causes

When a physician acts appropriately during a birth emergency, birth injury can be avoided. Unfortunately, if the physician or other medical professional is negligent - failing to recognize a potential birth injury issue, or incorrectly treating a potential birth injury situation - a preventable, and often permanent, injury can result. Many times birth injury is caused by factors associated with a pregnant mother's health. These health issues must be closely monitored, detected, and corrected by a physician to avoid complications with pregnancy and labor that could lead to a birth injury. Other birth injury cases stem from labor itself. If the physician fails to detect improper positioning of the fetus in the birth canal, or fails to correctly respond to a situation of this nature, serious birth injury can result. This is the responsibility that the physician is trusted with and he or she is expected to carry out this responsibility. The birth injury lawyers at our office in Philadelphia are committed to ensuring that medical professionals who act negligently are held accountable for their actions.

Years of rehabilitation and permanent life changes are often the result of birth injury. While the odds of serious birth injury are fairly low, in those unfortunate cases that should have been prevented, the assistance of experienced birth injury lawyers can help alleviate much of the financial burden that birth injury presents. If you or a family member has suffered as a result of a birth injury, please contact our birth injury lawyers in Philadelphia, Pennsylvania for a comprehensive review of your case.

Hypoxia – Newborn Head Cooling Cap

Recently, children who have been injured because of the lack of oxygen during the birth process have been offered a new treatment called a “Cool-Cap.” The newborn cooling cap (Olympic Medical Cool Care System) is being used to try to reduce the chance that the baby will suffer permanent, debilitating injuries, which can result from the lack of oxygen during the birth process. The newborn “Cool-Cap” was first described in a journal article published in The Lancet in February, 2005. Only 25 hospitals around the world are currently offering such treatments. In order for a baby to be accepted into a “Cool-Cap” program, the decision must be made within the first six hours of life. If your baby has been treated with a “Cool-Cap” or if the newborn cooling cap treatment was suggested for your baby, there is a much higher chance that the circumstances of the delivery could form the basis for a birth injury claim. The birth injury lawyers at our Philadelphia, Pennsylvania office can have a physician review your medical records to determine if malpractice occurred.
